Digital Millennium Copyright Act (DMCA) Policy

KakeVPN does not support or condone the use of our service for copyright infringement. We adhere to U.S. copyright laws, including the provisions of the Digital Millennium Copyright Act (DMCA), and expect our users to do the same.

Transitory Digital Network Communications Provider

KakeVPN operates an automated virtual private network (VPN) service. Our service is fully automated, and we do not log user activities. We do not select recipients or monitor user-transmitted content. Additionally, we do not store, access, or modify any user-accessed content.

As such, KakeVPN’s VPN service qualifies as a provider of transitory digital network communications under 17 U.S.C. § 512(a) of the Copyright Act. Since we do not store user-accessed content, we cannot remove any allegedly infringing material. Furthermore, our privacy protection measures prevent us from identifying individual users engaged in copyright infringement.

DMCA Takedown Notices

While KakeVPN strives to assist copyright owners and their agents in addressing copyright infringement, we require valid and complete DMCA takedown notices to investigate reported infringing activities. Before initiating an investigation, copyright owners or their authorized agents must provide a valid DMCA takedown notice to KakeVPN’s designated DMCA Agent.

In accordance with 17 U.S.C. § 512(c)(3), DMCA takedown notices must include:

– Identification of the copyrighted work claimed to be infringed.
– Identification of the allegedly infringing content.
– Sufficient information to locate the infringing content.
– Contact information for notification purposes.
– Statement affirming good faith belief of unauthorized use.
– Identification of the potentially responsible user.
– Statement under penalty of perjury affirming accuracy.
– Physical or electronic signature of the owner or agent.

Incomplete notices may be deemed invalid, and KakeVPN will not investigate them.

Counter-Notifications

KakeVPN respects the DMCA’s counter-notification provision. If a user submits a valid counter-notification, we comply with the DMCA’s requirements.

Counter-notifications must include:

– Sufficient identifying information of the user.
– Physical or electronic signature.
– Identification of removed content.
– Statement under penalty of perjury affirming good faith belief of misidentification.

Counter-notifications should be sent to the same address as DMCA takedown notices.

Repeat Infringer Policy

KakeVPN complies with copyright laws by terminating repeat infringers’ accounts. If a user is identified as a repeat infringer, their account will be terminated. Users terminated under this policy are prohibited from subscribing again to regain access to our service.
